Who will get Pension after death of pensioner?

There have been repeated queries with respect to LTA nomination for widows.

As per the No. 1/2(40)/2022-P&PW (E) Government of India Ministry of Personnel, P.G. & Pensions Department of Pension & Pensioners' dated March 31, 2022 and Para 5 of Payment of Arrears of Pension (Nomination) Rules

 This Ministry letter No. 1(16)/2009-D(Pen/Policy) dated 15.03.2010 stipulates that in the event of death of family pensioner, the right to receive any arrears of family pension would automatically pass on to the eligible member of the family next in line

From the Para above it is implicit that the arrears of pension in case of Family pensioners will go to the eligible member of the Family next in line. This is to be automatic.

Further as per the latest GOI orders reproduced below from a News Portal it is clear that a family Pensioner is also now permitted to make a Nomination for LTA.

New rules have been implemented in this regard. The Department of Pension and Pensioners' Welfare (DOPPW) said in an official statement that the Central Government has made changes in the Civil Services (Pension) Rules, 2021. Now women employees working in the government sector will be able to give pension to their children.


Son or daughter will also be entitled to family pension

This landmark decision of the government will have an impact on the social fabric. Its social and economic effects will be visible. At present, a female employee can make only her husband a nominee. Now she will be able to make any of her sons and daughters a nominee in the family pension. This official information was released on Monday.

At present only husband could be made nominee

Union Minister of State Jitendra Singh said that this decision is a step taken towards Prime Minister Narendra Modi's objective of providing equal rights to women. According to the new rules, a female employee can entitle her son or daughter for family pension. Due to the new rule, in case of his death, the family pension will be available to the son or daughter. At present there was no this provision for women employees. She had to make her husband eligible for family pension. Only in special circumstances could she choose any other member of the family.

If there are no children then only the husband will get the pension

Jitendra Singh said that we have given power in the hands of women employees. With this reform, women will get additional rights in case of marital discord, divorce process, dowry or other court cases. According to DOPPW, women employees or pensioners will have to submit a written application. In this, they will have to demand that their son or daughter be made the nominee in place of their husband. The government has said that if a female employee does not have children, her pension will be given to her husband. However, if the husband is the guardian of any minor or disabled child, he will be eligible for pension till he attains majority. The pension will be given to the child only after he attains adulthood.

 

In view of above the blocking of LTA Nominees of Family pensioners is considered illegal in view of the latest orders.

 

However, if SPARSH authorities are still not willing to allow LTA Nomination for widows then it is requested that in view of the latest provisions ,SPARSH should amend the software in the sequence of priority as follows

 1.All family pensioners be permitted LTA nomination

2.In case SPARSH insists on not allowing widows nominate for LTA then they be allowed to Update family members so that the NEXT is line is known to SPARSH

3.Report an event in the case of all pensioners' Family data.

The question here arises is that if in the light of the latest rules SPARSH is not willing to allow the provision to upload Family details then how will SPARSH who is NEXT in line? Further there needs to be a provision to report an event in the case of a Family member so that SPARSH data on NEXT in line remains updated.
